The legality of a caretaker Commission, which ensures day-to-day running of the European Union affairs while a new College is approved is well established and has several precedents. In these circumstances no new political initiatives can be launched.

Contrary to the comment in the Daily Telegraph, in no sense is the College of the European Commissioners, whether old or new, the “real government”. Decisions at European level are taken by the Council of Ministers, composed of representatives of elected national governments, and the European Parliament, which was elected in June 2009.
