EPSOs statement about the T-124/13 and T-191/13 judgment

  • As promised in our previous updates of 25 September and 21 October, EPSO would like to inform you of the latest state of play following the recent judgment of the General Court in cases T-124/13 and T-191/1 on the language regime for open competitions.
  • As stated previously, the rights of successful candidates in the three competitions concerned and all other competitions completed before the judgement are unaffected.
  • Similarly, unsuccessful candidates have no new right of appeal as a result of this judgement and should refrain from submitting an appeal on this basis as EPSO is unable to give a positive reply.
  • Competitions that are currently on-going will continue as normal.
  • The publication of competitions is suspended until further notice, while EPSO and the institutions put in place modified arrangements which take account of the judgement.
  • No firm date can be given at this stage for completing this work but it is hoped that EPSO will re-start the publication of open competitions in the coming months.
  • EPSO will provide further information as soon as it is available.

JUDGMENT ON LANGUAGE REGIME- STATEMENT FOR CANDIDATES

With regard to the recent judgment of the General Court in cases T-124/13 and T-191/13, case law confirms that the annulment judgment does not reopen expired appeal deadlines to contest the language regime in either on-going or already closed competitions.  EPSO therefore respectfully requests that candidates refrain from submitting complaints or Requests for Review on this basis as we are unable to give a positive reply.

As previously stated, the status of the successful candidates in the 3 competitions (EPSO/AST/125/12, EPSO/AST/126/12 and EPSO/AD/248/13) and/or their subsequent recruitment are not affected by the judgment.

EPSO’s statement on the General Court judgment in Cases T-124/13 and T-191/13

On September 24 2015 the General Court delivered a judgment in Cases T-124/13 Italy vs Commission and T-191/13 Spain vs Commission annulling three Notices of Competition from 2012 and 2013.

This annulment concerns the Notices of Competition for competitions EPSO/AST/125/12 – Assistants (AST3) in the fields of Audit, Finance/Accounting and Economics/Statistics; EPSO/AST/126/12 – Assistants (AST3), in the Research Sector, in the fields of Biology, Life and Health Sciences, Chemistry, Physics and Materials Science, Nuclear Research, Civil and Mechanical Engineering and Electrical Engineering and Electronics; and EPSO/AD/248/13 – Administrators (AD6) in the Buildings Sector, in the fields of Security of Buildings and Building Services Engineering; and the requirement for candidates to choose English, French or German as their second language and as the main language of communication with EPSO.

EPSO is currently examining the Court ruling and all the implications on its work and will keep candidates informed moving forward. We can already confirm that the situation of successful laureates and the validity of reserve lists for competitions EPSO/AST/125/12, EPSO/AST/126/12 and EPSO/AD/248/13 are not affected by the ruling.
