Will the single market ban foam-filled furniture?

Statement: Some Member States ban the sale of foam-filled furniture in the interests of consumer safety. Others authorise it. What will happen in the Single Market?

Response: The Commission has not yet submitted a proposed directive on the fire protection properties of this type of furniture and their constituent materials. As long as there is no existing EC directive harmonising the national rules in this field, it is up to the Member States to decide which level of protection for health and safety they want to maintain for their customers, without at the same time introducing disproportionate barriers to trade. In other words, existing national legislation still applies pending any new rules coming into effect.
